On February 9, the U.S. Commodity Futures Trading Commission (CFTC) announced the adoption of final rules amending CFTC Regulation 4.5, the exclusion from registration as a commodity pool operator that most mutual funds rely on. For registered investment companies and their investment advisers, this development has spawned many interpretative, operational and compliance issues that must be identified, resolved and implemented on or before the effective date.
