Since its passage in 2018, prosecutors have ramped up their reliance on EKRA’s new and extraordinary reach. The Act applies to services covered by both government and private health care programs, and prohibits remuneration provided in connection with referrals to and from laboratories, clinics, recovery centers, and other clinical treatment facilities. EKRA should be top of mind for health care executives as a developing area of the law and governmental priority, as it may require laboratories and certain health care entities to reassess their relationships with their contractors, employees and outside sales and marketing personnel, and will focus on private health care providers (not just on government health care programs).
