Vedder Price Successfully Represents Oracle in Class Certification Case
On Friday, December 5, Judge George C. Hernandez Jr. denied certification of a class of technical analysts who alleged that Oracle America Inc., Vedder Price's client, failed to pay them overtime and prevented them from taking meal and rest breaks. The judge commented that the expert's methodology was flawed in proving the alleged widespread discrepancies between an Oracle database used to record the analysts' hours worked and another database used to cut checks to employees. In addition, the plaintiff had not shown that the expert could reliably identify meal and rest breaks for a substantial number of technical analysts.
