Vedder Price Secures Affirmation of Dismissal of Unruh Civil Rights Act in California Appellate Court
A Vedder Price litigation team secured a significant win on May 10, 2023, in the California Second Appellate District Court, Division Three, on behalf of client Webroot Inc., an affiliate of Open Text.
The Superior Court of Los Angeles County had entered a judgment of dismissal after sustaining Webroot’s demurrer to the plaintiff’s complaint, which alleged a violation of California’s Unruh Civil Rights Act, which provides protection from discrimination by all business establishments in California, by intentionally maintaining a retail website that is inaccessible to visually impaired individuals.
The Appellate Court affirmed the lower court’s judgment of dismissal, finding that plaintiff was unable to establish intentional discrimination under the statute and that Webroot’s website does not constitute a “place of public accommodation.”
