United States: SCOTUS Potentially Limits CSA’s Application” in The Texas Lawbook. In the article, they discuss the United States Supreme Court’s long-anticipated opinion in Ruan, in which the Court for the first time held that a physician’s subjective good faith in writing controlled substances prescriptions is a defense to criminal charges for violating the Controlled Substances Act. The decision firmly—and correctly—establishes the availability of a good faith defense to providers that they had the requisite intent to violate the CSA.
