Government Contracts Group Wins Bid Protest Case in Maryland
Vedder Price Shareholder Eric J. Marcotte, a member of the Government Contracts practice in the firm’s Washington, DC office, represented The Active Network, Inc. before the Maryland State Board of Contract Appeals (MSBCA) in a challenge to the proposed award of a multimillion-dollar contract to provide call center services. The contract, the largest of its type in the state of Maryland, involves handling nearly 2 million calls annually from members of the public seeking information or making service requests.
Following a weeklong trial and post-trial briefing, the MSBCA sustained Active Network’s protest, requiring that a new bid competition be held. In the meantime, Active Network, as the incumbent contractor, will continue to provide call center services under its prior contract. Assisting Mr. Marcotte with this matter was Vedder Price Associate Kelly E. Buroker, also a member of the Government Contracts practice in the firm’s Washington, DC office.
