David M. Hernandez, a Shareholder in Vedder Price’s Washington, DC office and member of the firm’s Global Transportation Finance team, will present at the National Business Aviation Association’s (NBAA) Tax, Regulatory & Risk Management Conference on October 14–15 and at its Business Aviation Convention & Exhibition (NBAA-BACE) on October 16–18, both in Orlando, Florida.

The two-day Tax, Regulatory & Risk Management Conference—designed for attorneys, CPAs, financial advisors, CFOs and flight operations professionals—provides attendees with the tools necessary to develop strategies for connecting tax and regulatory planning while protecting their ownership structure from audits.

In their session, “Introduction to FARs & Permissible Operating Models,” Mr. Hernandez and his co-presenters will discuss what makes certain flight operations legal from an FAA perspective. This panel will analyze the most common permissible operating structures and will explain limitations of Part 91 and why “holding out to the public” and receiving “compensation” regarding air transportation are such critical concepts. The panelists will also discuss the various Part 91 and 135 scenarios including time-sharing agreements, dry leasing, operational control, the associated regulatory risks, and the real and serious consequences of failing to comply with FAA regulations.

Following the Tax, Regulatory & Risk Management Conference, the three-day NBAA-BACE brings together over 25,000 current and prospective aircraft owners, manufacturers and customers.

Mr. Hernandez will present “Knowing Your Customers: How to Avoid Dealing with Bad Actors,” where he and his co-presenters will discuss the increasing importance of to properly vetting transactions, given that business aviation companies routinely have to deal with middlemen rather than the ultimate beneficial owners of an aircraft.

Mr. Hernandez is a member of the NBAA Tax Committee and the NBAA Regulatory Issues Advisory Group.
