Intellectual Property Shareholder Daniel H. Shulman and Associate Joshua L. Grant recently co-authored the article “Intersection of Trademark and Franchise Law” in the Loyola Law Journal, Vol. 53. The article covers how trademark law and franchise law intersect, and how that intersection can lead to potential pitfalls for trademark licensors. Mr. Shulman, an adjunct professor of legal writing at Loyola University Chicago School of Law, and Mr. Grant reference their vast experience in trademark law to discuss how a trademark agreement can inadvertently become a franchise agreement, giving the licensee numerous rights the licensor never intended to provide.
